18 marzo 1213, luogo sconosciuto detto “Pulaturio”

Uguccione di Malvicino e il figlio Gentile si affidano alla protezione di Fildesmido da Mogliano, gli promettono due terzi dei loro beni e gli forniscono sostegno militare concedendogli il controllo della torre fino al compimento della guerra.

In nomine Domini Amen. Nos quidem Oguiczio de Malvicino et meus filius Gentilis propria bona nostra voluntate, sana mente et libero arbitrio, nulla vi seu timore cogente, promittimus, facimus et iuramus vobis domino Fildesmido et filiis Falleronis et vestris heredibus hominum et fidelitatem, manus nostras infra vestras in signum hominii more solito vaxallorum intromittendo et numquam de cetero faciemus, nec facienti vel facere volenti consentimus aliquid quod pertineat ad dedecus vel detrimentum vestrarum personarum vel vestrorum heredum vel vestrarum rerum quas habetis vel in antea adquirere poteritis set bona fide, sine fraude vestras personas vel vestrorum heredum vel vestrarum rerum quas habetis vel in antea adquirere poteritis set bona fide, sine fraude  vestras personas vel vestrorum heredum et vestras res presentes et futuras salvabimus et defendemus pro posse. Et si aliquis, nobis scientibus, contra hec facere voluerit, pro posse obviabimus, vobis citius quam poterimus denuntiantes. Item promittimus, concedimus et damus tibi domino Fildesmido vestrisque heredibus duas partes omnium predictarum rerum et promittimus et iuramus per  nos et nostra bona vobis facere hostem sive exercitum et parlamentum et pro vobis facere guerram et pacem et vobis dare in tenutam turrim castri Malvicini usque ad perfectionem  guerre et, guerra finita , nichilominus sit in vestro arbitrio et voluntate quid de ipsa turri facere velitis. Et promittimus quod faciemus tertiam partem hominum curie Malvicini habitare in castro Malvicini et alias duas partes habitare vel in Collecreta vel iuxta ecclesiam  Sancti  Constantii, vel alibi prout vos ad invicem concordaveritis. Item facimus finem et pacem perpetuam et quietationem omnium maleficiorum contra nos commissorum quam omnibus vel  singulis  vestris  adiutoribus. Item  nostra voluntate et consensu  sint  vobis  salve  omnes  penarum  petitiones si in aliqua  pena actenus  uc  usque  vobis incidimus nec per istam compositionem vobis aliquid periudicium fiat  quominus ipsas penas petere et exigere possitis. Item sint salva omnia instrumenta inter nos et vos olim habita et maxime instrumentum illud quod factum fuit aput sanctam Crucem Masse per manum magistri Mauricii notarii. Que omnia et singula predicta promittimus per nos nostrosque heredes et nostra bona vobis vestrisque heredibus adtendere et observare et numquam in aliquo contravenire sub pena omnium nostrorum hominum quos habemus in curia Malvicini ut ipsi homines cum suis bonis et servitiis et sicut unquam nobis teneantur in vos et vestros heredes, dominum Fildesmidum, duas partes omnium predictarum rerum et alia filiis Falleronis nomine pene veniant et vobis cedimus et mandamus omne ius et actionem quod et quam in eis et eorum rerum et bonis habemus et vos procuratores in rem vestram facimus ut vestro nomine et nostro mandato possitis agere, excipere et tunc experiri si in predicta pena incidemus et, pena soluta, omnia et singula predicta firma premaneant. In quibus omnibus et singulis supradictis renuntiamus omnium legum et decretorum consilio vel auxilio speciali sive generali et omni exceptioni coherenti rei vel persone et omni privilegio apostolicali sive imperiali vel eorum nuntio nobis indulto seu posterum indulgendo et numquam his predictis contra vos utemur sub predicta pena rato manente pacto et hoc ideo fecimus quia antecessores nostros vestris fecerunt. 

Anno domini M CC XIII, domino Ottone imperatore, xviii die intrante mense martii, indictione prima. Actum in loco qui dicitur Pulaturius de die martis, indictionis predicta, prefato domino Fildesmido, Barigano et Oguiczio cum suo filio Gentile scribere mandantibus. Interfuerunt Bonaventura Rainaldi Lamberti, Passaro, Philippus eius frater, Rainuccio Petri, Valterius Caprilis, Brunfors, Rainaldus Petroni abbas ecclesie S.te Marie et alii quam plures et huius rei rogati sunt testes. 

Ego Bonsignus notarius hiis omnibus interfui et ut supra legitur rogatus scripsi. Bonsignus notarius a sacro romano imperio destinatus hoc instrumentum scripsit sicut fuit rogatus.

ITA        Nel nome di Dio amen. Noi Uguccione di Malvicino e mio figlio Gentile, di nostra spontanea volontà, nel pieno delle nostro intelletto e per nostra libera decisione, non costringendoci nessuna violenza o timore, promettiamo, rendiamo e giuriamo a voi Fildesmido e ai figli di Falerone e ai vostri eredi l’omaggio e la fedeltà, mettendo le nostre mani nelle vostre in segno di omaggio secondo la consuetudine dei vassalli e mai in futuro faremo, né consentiremo a chi lo faccia o lo voglia fare, qualsiasi cosa che miri al disonore o che vada a danno delle vostre persone o dei vostri eredi o dei vostri beni che avete attualmente o in futuro potrete acquistare; piuttosto in buona fede, senza frode salveremo e difenderemo per quanto potremo le vostre persone o dei vostri eredi e i vostri beni presenti e futuri. E se qualcuno, che noi sappiamo, al contrario, fosse intenzionato a fare ciò, per quanto possibile ci opporremo, dandovene notizia prima possibile. Inoltre promettiamo, concediamo e diamo a te signor Fildesmido e ai vostri eredi due parti di tutte le cose predette e promettiamo e giuriamo per noi e per i nostri beni di fare battaglia per voi o preparare l’esercito e riunire gli uomini e per voi muovere guerra o fare pace e a voi consegnare in pegno la torre del castello di Malvicino fino alla fine della guerra, finita la guerra, tuttavia sia nel vostro arbitrio e nella vostra volontà ciò che della stessa torre vorrete fare. E promettiamo che faremo sì che la terza parte degli uomini della curia di Malvicino abitino nel castello di Malvicino  e che le altre due parti abitino o a Collecreta o accanto alla chiesa di S. Costanzo, o in altro luogo che voi diversamente concorderete. Inoltre poniamo fine e facciamo pace perpetua e rinunciamo ad ogni pretesa per tutti i delitti commessi contro di noi, sia da voi che dai vostri singoli aiutanti. Inoltre per nostra volontà e con il nostro consenso vi siano risparmiate tutte le richieste [giudiziarie] di sanzioni se in qualche risarcimento fino a questo momento o per il futuro siamo incappati e attraverso questa pace a voi non venga alcun pregiudizio sul chiedere ed esigere gli stessi risarcimenti. Inoltre restino salvi tutti gli atti tra noi e voi precedentemente conclusi ed in particolare l’atto che fu stipulato presso Santa Croce di Massa per mano del maestro Maurizio notaio. Promettiamo per noi e per i nostri eredi e per i nostri beni, a voi e ai vostri eredi, di attenerci e adempiere quanto sopra, sia per l’intero che nei singoli articoli e di non contravvenire mai ad alcuna [delle clausole di cui sopra] sotto pena dei nostri uomini che abbiamo nella curia di Malvicino così che gli stessi uomini con i loro beni e le loro servitù e fino a che sono tenuti verso di noi lo siano verso di voi e dei vostri eredi; il signor Fildesmido  in due parti di tutte le cose predette e le altre ai figli di Falerone a nome di coloro che a breve verranno [indicati] e a voi cediamo e trasferiamo ogni diritto e azione nei modi e nei tempi in cui a noi spettano su di loro e sui loro beni e nominiamo voi amministratori nei vostri beni, così che possiate a vostro nome e su nostro mandato agire, eccepire e anche intentare causa contro di noi se dovessimo incorrere nella predetta pena e, pagata la sanzione, il contratto e le singole clausole rimangano efficaci. In tutto quanto sopra, e nei sopra indicati articoli, rinunciamo a qualsiasi previsione di tutte le leggi e decreti o ad altro mezzo speciale o generale e a ogni eccezione legata alla cosa o alla persona e a ogni privilegio apostolico o imperiale o loro concessione a noi fatta o rivolta al futuro e mai  useremo quanto sopra contro di voi sotto la predetta pena, rimanendo valido il patto, e ciò facemmo per la ragione per cui i nostri predecessori lo fecero ai vostri.

Nell’anno del Signore 1213,  Ottone imperatore, il 18 del mese di marzo, prima indizione. Fatto nel luogo che viene detto Pulaturius nel giorno di martedi, indizione predetta, il predetto signor Fildesmido, Baligano e Uguccione con suo figlio Gentile che ordinano di scrivere. Intervennero Bonaventura di Rinaldo di Lamberto, Passaro, Filippo suo fratello, Rainuccio di Pietro, Gualtiero Caprilie, Brunforte, Rinaldo di Petronio abate della chiesa di S. Maria e molti altri  e di ciò sono invitati come testimoni.

Io Bonsigno notaio fui presente a tutto ciò e come si legge sopra, invitato, scrissi. Bonsigno notaio designato dal sacro romano impero scrisse questo atto come richiesto.

Uguccione of Malvicino and his son Gentile put themself under the protection of Fildesmido. They promise him two thirds of their own property and their militar support. They also give up on using the castle tower until the end of the war.

In the name of God amen. We Uguccione di Malvicino and my son Gentile, at our own free will, in the fullness of our intellect and by our free decision, not forced by any violence or fear, pledge homage and loyalty to you Fildesmido and to the children of Falerone and to your heirs there, putting our hands in yours as a sign of homage according to the custom of vassals, and never in the future we will do, nor will we allow those who do or are willing to do it, to do anything  that goes to the detriment or dishonor of your person or your heirs or property that you currently have, or may have previously acquired; rather in good faith, without fraud we will do everything in our power to defend your person or your heirs, and your present and future assets. And if we are aware of someone who is not willing to do this, we will oppose him to the best of our ability, and inform you as soon as possible. We also promise, grant and give to you Fildesmido and your heirs two parts of all foretold property, and we promise and swear for us and our possessions to capture your enemies, or prepare the army and gather our men, to wage war or make peace on your behalf, and it is up to you to allow us to access the tower of the castrum of Malvicino until the end of the war. When the war is over, however, you will establish what to do with the tower itself. And we promise that we will ensure a third  of the men of the curia of Malvicino will remain in the castrum of Malvicino, and that the other two parts stay either in Collecreta or next to the church of S. Costanzo, or in another place that you will establish. We also put an end to, and make perpetual peace and acquittance of all crimes committed against us both by you and by your individual helpers. Furthermore, by our will and with our consent, you are spared all [judicial] requests for penalties if we have requested some compensation up to this moment, and there is no prejudice that you cannot ask and demand the same compensation. Furthermore, all the previously concluded deeds between us and you, and in particular the deed that was stipulated at Santa Croce di Massa by the hand of master Maurizio notary, are still valid. We promise for us and for our heirs and for our assets, to you and your heirs, to abide by and fulfill the above, both for the whole and the individual clauses, and to never contravene any [of the above clauses ], swearing on our men in the curia of Malvicino, their goods and their servants, and as long as they are subjected to us, they are also subjected to you and your heirs.  Fildesmido will be assigned two parts of all the aforementioned things and the rest to the sons of Falerone, whose names will shortly be [indicated] [nomine pene veniant], and to you we give and transfer all of our and their rights, actions, assets, in the ways and times in which we are entitled to them, and we appoint you administrators of your assets, so that you can act, plead on our behalf and even sue us in your name if we incur the aforementioned penalty and, once the penalty has been paid, the contract and the individual clauses remain effective. Regarding all of the above, and by virtue of the aforementioned  clauses, we renounce any lawful right to compensation , or other special or general provision and any exception related and to any apostolic or imperial privilege, or any past or future concession made to us. We will never use the above against you under the aforementioned penalty, while the covenant remains valid, and we did this for the reason our predecessors did it to yours.

In the year of the Lord 1213, Otto emperor, on the 18th of March of the first indiction. Issued at the place that is called Pulaturius in March,  first indiction, written upon request of the aforementioned Fildesmido, Baligano and Uguccione with his son Gentile. Bonaventura of Rinaldo di Lamberto; Passaro, Filippo’s brother, Rainuccio of Pietro, Gualtiero Caprilie, Brunforte, Rinaldo of Petronio abbot of the church of S. Maria, and many others intervened and are invited as witnesses of this. I Bonsigno, the notary, was present to all this and, as you read above, I write. Bonsigno notary designated by the Holy Roman Empire wrote this deed as requested.
